Public Offer

Hosting services agreement of ZonaVPS.

This document is an official offer (public offer) by the Individual Entrepreneur Sozonov Matvey Andreevich, INN: 732729080609, hereinafter referred to as the "Contractor," and contains all the essential terms of the contract for the provision of hosting services.

In accordance with Articles 435 and 437 of the Civil Code of the Russian Federation, this document is addressed to an unlimited circle of persons and constitutes a public offer. Acceptance of the terms of this Offer signifies the conclusion of a contract between the Contractor and the Customer on the terms set forth below.

1. Terms and Definitions

1.1. Offer — This document, published on the Internet.

1.2. Acceptance — The Customer's full and unconditional acceptance of the terms of the Offer by registering on the Contractor's website, paying for services, or actually starting to use the services.

1.3. Customer — An individual or legal entity, or an individual entrepreneur, who has accepted the Offer.

1.4. Services — Services for providing computing resources, virtual servers (VPS/VDS), data hosting, and other related services provided under the ZonaVPS brand.

2. Subject of the Agreement

2.1. The Contractor undertakes to provide the Customer with hosting services in digital form by granting access to computing resources and network infrastructure in accordance with the selected tariff plan, and the Customer undertakes to pay for and accept such services.

2.2. Services are provided electronically, remotely, without the provision of a physical medium.

2.3. The moment service provision begins is considered to be the moment the Customer is granted access to the services (service activation, issuance of access credentials, server startup).

2.4. After the start of service provision, a refund is possible solely in the event of complete inoperability of the service due to the Contractor's fault, provided that the fact of inoperability is confirmed by the Contractor's support service.

2.5. The Customer has the right to request a refund within 14 calendar days from the date of payment if the service has not been used. In all other cases, refunds are not provided, except as directly provided by the legislation of the Russian Federation.

3. Procedure for Acceptance of the Offer

3.1. Acceptance is considered to be the Customer performing one or more of the following actions: - registering an account on the ZonaVPS website; - paying for the Contractor's services; - actual use of the services.

3.2. From the moment of Acceptance, the contract is considered concluded in written form.

4. Rights and Obligations of the Parties

4.1. The Contractor undertakes to:

  • provide Services in accordance with the selected tariff;
  • ensure the operability of equipment within the limits of technical capabilities;
  • take measures to protect the Customer's data.

4.2. The Contractor has the right to:

  • suspend the provision of Services in case of violation of the terms of the Offer;
  • change tariffs and terms with prior notice;
  • restrict access if illegal activity is suspected.

4.3. The Customer undertakes to:

  • use the Services in accordance with the legislation of the Russian Federation;
  • refrain from hosting prohibited content (viruses, spam, malware, illegal materials);
  • pay for the Services in a timely manner.

4.4. The Customer has the right to:

  • receive Services of proper quality;
  • contact support service;
  • withdraw from the Services in accordance with the procedure provided for in the Offer.

5. Cost of Services and Payment Procedure

5.1. The cost of Services is determined according to the tariffs published on the Contractor's website.

5.2. Payment is made on a 100% prepayment basis using payment aggregators (including, but not limited to: YooKassa, Heleket, and other methods available on the website).

5.3. The moment of payment is considered to be the receipt of funds or confirmation from the payment aggregator.

5.4. The Contractor is not responsible for the operation of payment aggregators and banks.

5.5. In the event of a chargeback, the Contractor has the right to suspend the provision of Services until the situation is resolved.

5.6. Payment system commissions are non-refundable.

6. Service Level Agreement (SLA)

6.1. The Contractor strives to ensure service availability (Uptime) at a level of 99.5% per month.

6.2. The calculation excludes:

  • scheduled maintenance;
  • emergency work;
  • failures caused by the Customer;
  • force majeure.

6.3. If availability falls below 99.5%, the Customer has the right to request compensation:

  • 99.0–99.49% — 5%;
  • 98.0–98.99% — 10%;
  • below 98% — 20%.

6.4. Compensation is provided in the form of bonus funds and is not paid out as money.

6.5. The total amount of compensation does not exceed 20% of the cost of services.

7. Liability of the Parties

7.1. The Contractor is not liable for indirect damages, lost profits, or data loss.

7.2. Liability is limited to the amount paid for the last billing period.

7.3. The Customer is independently responsible for backing up their data.

7.4. The Contractor is not responsible for the content hosted by the Customer.

7.5. Upon receiving a notification from authorized bodies, the Contractor has the right to restrict access to information.

8. Confidentiality and Personal Data

8.1. The processing of personal data is carried out in accordance with Federal Law No. 152-FZ "On Personal Data".

8.2. The Customer agrees to the transfer of data to payment aggregators solely for the purpose of processing payments.

8.3. Transfer to third parties is carried out only in cases provided for by the legislation of the Russian Federation.

9. Term of Validity and Data Deletion

9.1. The contract is valid for the paid period.

9.2. In the absence of renewal, services are automatically terminated.

9.3. Data is deleted within 1 calendar day after the termination of service provision.

9.4. The Contractor is not responsible for data loss after deletion.

10. Acceptable Use Policy (AUP)

10.1. The use of services is prohibited for:

  • distributing malware;
  • conducting DDoS attacks;
  • sending spam and phishing;
  • hosting illegal materials.

10.2. Guaranteed bandwidth — up to 100 Mbit/sec (unless otherwise specified by the tariff).

10.3. Maximum traffic volume — 300 TB per month.

10.4. If the limit is exceeded, an additional payment may be required: 1 TB — 129 RUB.

10.5. The Contractor has the right to:

  • limit the speed to 1 Mbit/sec;
  • suspend services;
  • offer a tariff change;
  • terminate the provision of services without a refund.
